By placing an order for products or services from this website, you affirm that you are of legal age to enter into this agreement, and you accept and are bound by these terms and conditions. You affirm that if you place an order on behalf of an organization or company, you have the legal authority to bind any such organization or company to these terms and conditions. 

You may not order or obtain products or services from this website if you: (i) do not agree to these terms and conditions; (ii) are not the age of majority in your province or territory of residence; or (iii) are prohibited from accessing or using this website or any of this website's contents, products or services by applicable law. 

Acceptance of Terms:

Prairie Clean Enterprises, operating as “Prairie Clean Litter” (referred to below as “PCE”, “us” or “we”) provides the website and any related sites including external social media sites (collectively, the “Site”) to you, the user (“Customer” or “you”), subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the “Terms”), as well as any other written agreements between us and you. By accessing or using the Site or purchasing products from PCE through the Site, you agree to be bound by these Terms as well as our Privacy Policy and any other policies referenced herein or available by hyperlink. These Terms form a legally binding agreement between you and PCE. If you do not agree to all the provisions of these Terms, you must not use the Site or services. Please read these Terms carefully before placing an order or creating an account. These Terms apply to all users of the Site, including browsers, customers, merchants, and content contributors. In the event of any conflict between these Terms and any other policy (such as a Returns Policy) posted on our Site, these Terms will prevail to the extent of the inconsistency, except where doing so would violate applicable consumer protection laws or other laws in your jurisdiction. 

Changes to the Site: 

PCE reserves the right, in our sole discretion, to either modify or discontinue the Site, including any of the related features, at any time with or without notice to you. We will not be liable to you, or any third party, should we exercise such right. Any new features that augment or enhance the then-current services on the Site shall also be subject to these Terms. 

Changes to Terms: 

PCE reserves the right to update or modify these Terms at any time. We will provide notice of material changes (such as by posting an updated version with a new effective date in these website terms, and/or by email notification for registered users). Your continued use of the Site or services after any changes constitute acceptance of those changes. If you do not agree with the revised terms, you must stop using the Site. For Quebec consumers: no amendment to these Terms will apply to you unless you expressly consent to it, if such amendment would diminish your rights or increase your responsibilities (this is in accordance with Quebec’s Consumer Protection Act). 

Availability 

Our Site may be accessible worldwide but this does not mean that all of our products and services are available in your country or that information available via the Site is legal or available in your country. Access to certain products and services in certain countries may be blocked by us or foreign governments. It is your responsibility to ensure your use of our Site is legal where you are located. Additional terms and conditions may apply to purchases of certain products or services and to specific portions or features of this Site, all of which terms are made a part of these Terms.

The content of the Site is for informational purposes only, unless otherwise indicated, and is not intended to provide any specific financial or professional advice, and should not be relied upon for that purpose. Users should not act or rely on the information and content contained within the Site without seeking the advice of a professional.  

Except where expressly stated otherwise, all Site information is intended to be general in nature. PCE makes no representations or warranties and assumes no responsibility for how you use this information or any third-party information. While PCE uses best efforts to update and keep current the information available on the Site, the information is not guaranteed to be current or up to date, except where PCE is required by applicable law to provide current or up to date information. 

Account Creation and Security: 

To purchase products or certain services, you may need to create an online account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide current, complete, and accurate information for all purchases and account registration. You must be the age of majority in your province or territory to open an account or use our services (or have the consent of a parent/guardian). You agree that we may require you to implement specific security measures and/or comply with specific security procedures communicated to you from time to time, for the purpose of maintaining the security of your account. For example, we may require you to follow a multi-factor authentication procedure prescribed by us before you can access your account through the Site. PCE reserves the right to refuse service, terminate accounts, or cancel orders at our discretion if we suspect fraud, misuse, or violation of these Terms. 

User Content: 

The Site may now or in the future permit you to upload user content such as documents, images and text (the “User Content”). You are solely responsible for any User Content and for any communication and activity related to the Site that occurs under your account. You will also be liable for any loss or damage resulting, directly or indirectly, from the distribution of your User Content. You hereby grant to PCE a worldwide, royalty-free, perpetual, irrevocable, sublicensable and transferable right and license to use, reproduce, modify, adapt, publish, translate and distribute any and all User Content for the purpose of providing its services to you. 

Permissible Use of Site: 

  • You are solely responsible for your use of the Site. You agree as follows with respect to your use of the Site:  
  • to use the Site and services only for lawful purposes and in accordance with these Terms; 
  • not to misuse the Site or engage in any activity that interferes with or disrupts the Site (including by transmitting viruses or malicious code); 
  • not to bypass, disable or otherwise interfere with any security-related features of the Site, or attempt to gain unauthorized access to any portion of the Site or its systems; 
  • not to alter or modify any part of the Site or its systems; 
  • not to take any action that imposes or may impose (as determined by PCE in its sole discretion) an unreasonable or disproportionately large load on PCE’s (or its third-party providers’) infrastructure; 
  • not to use or launch any system that accesses the Site automatically or to install or transmit any computer program or software on or via the Site; 
  • not to distribute, sublicense, or transfer any part of the Site to any third party; 
  • not to reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of any part of the Site, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Site); 
  • that you are not entitled to remuneration or compensation of any kind from us for your use of the Site; and 
  • not to use the Site for any commercial purpose not intended to be allowed by the Site without our prior written consent. 

You are not permitted to use the Site for any other purpose except as authorized by these Terms. You are not permitted to make any commercial or derivative use of the Site, or to use any data mining, robots, or similar data gathering and extraction methods with respect to the Site or any content contained therein. 

YOUR FAILURE TO COMPLY WITH ANY OF THE ABOVE CONDITIONS AND RESTRICTIONS OF USE CONSTITUTES GROUNDS FOR US TO IMMEDIATELY, AND IN OUR SOLE DISCRETION, TERMINATE YOUR ACCESS TO AND USE OF THE SITE AND ITS CONTENTS. IN SUCH EVENT, WE SHALL HAVE NO LIABILITY TO YOU OR ANY THIRD PARTY FOR YOUR FAILURE TO COMPLY WITH THESE TERMS OR ANY LOSSES OR DAMAGES THAT MAY RESULT FROM YOUR USE OF THE SITE, NOR FOR ANY INTERRUPTION OR TERMINATION OF YOUR ACCESS OR USE OF THE SITE. 

In addition, you acknowledge that we will cooperate fully with investigations of violations of systems or network security at the Site, including without limitation cooperating with law enforcement authorities in investigating suspected criminal violations. 

Resale and Commercial Use Restrictions 

Products are sold for personal household use only. Commercial resale, redistribution, export, or use in a business operation without our prior written authorization is strictly prohibited. 

We reserve the right to cancel or limit orders that appear to be placed by dealers, resellers, distributors, or parties engaged in arbitrage or bulk purchasing activity. 

Intellectual Property 

All content on the Site, including text, graphics, logos, images, and software, is the sole property of PCE or its licensors and is protected by copyrights, trademarks, service marks, patents, or other proprietary or intellectual property rights and laws. You do not acquire any ownership rights by using the Site. We grant you a limited, revocable license to access and use the Site for personal, non-commercial use in accordance with these Terms. Any other use (such as copying content for republication, reverse engineering our software, etc.) is prohibited without our prior written consent. You may not use any trademark, logo, or other proprietary information from our Site without permission. Any unauthorized use of the materials appearing on the Site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. PCE reserves all rights not expressly granted in these Terms. 

Third-Party Sites and Information: 

The Site may link you to other sites on the Internet or otherwise include references to information, documents, software, materials and/or services provided by other parties. Please review the terms of use and privacy policies of such third-party sites carefully before using their sites. These other sites and parties are not under our control, and you acknowledge that we are not responsible for the accuracy, copyright compliance, privacy practices, legality, decency, or any other aspect of the content of such sites, nor are we responsible for errors or omissions in any references to other parties or their products and services. The inclusion of such a link or reference is provided merely as a convenience and does not imply endorsement of, or association with, the sites or party by us, or any warranty of any kind, express or implied. You hereby agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against us and our affiliates with respect to such links, website and third-party information, and, to the extent permitted by applicable law, agree to indemnify and hold us and our affiliates harmless to the fullest extent allowed by law regarding all matters related to your use of the Site. 

Social Media: 

PCE maintains a presence on third-party social media sites, including Facebook, Instagram, X, TikTok and LinkedIn (the “Social Media Sites”). Information that is provided by PCE on the Social Media Sites is for information purposes only and should not be considered professional advice. 

Whenever a third party posts content to PCE’s social media accounts, this information remains the responsibility of the party submitting the content and does not represent PCE’s views. Comments posted by visitors to the Social Media Sites do not reflect the opinions of PCE or its partners. PCE cannot guarantee the appropriateness, accuracy or usefulness of any third-party posts or any third-party hyperlink, nor is PCE responsible for any unauthorized or copyrighted materials contributed by a third party on any PCE social media page. PCE reserves the right to remove or edit any third-party posts or comments on any PCE social media page that are inappropriate or that violate (or may violate) applicable regulations. 

These Terms apply to the Social Media Sites and comments that fail to comply with the Terms may result in being blocked from posting or connecting on the Social Media Sites. For greater certainty, all content published by PCE to the Social Media Sites may not be reproduced, distributed or published without prior permission from PCE. 

Product Information and Pricing: 

We strive to ensure that the product descriptions, pricing, and other content on our Site are accurate and up-to-date. However, errors or inaccuracies may occur. PCE does not warrant that product descriptions or other content are error-free or complete. If a product you purchase is not as described, your sole remedy is to return it in unused condition (as per our Return and Refund Policy). All prices are listed in Canadian dollars (CAD) unless otherwise noted. Applicable taxes and shipping fees will be added at checkout. We reserve the right to modify prices or discontinue products at any time without notice (but such changes will not affect orders already placed and accepted). In the event of a pricing error, we may cancel any orders placed for the incorrectly priced item, with a full refund provided, after notifying you of the error. 

Order Process and Contract Formation: 

Your placement of an order constitutes an offer to purchase the products in that order. We reserve the right to accept or reject any order in our sole discretion. Order acceptance occurs when we send you an order confirmation email and/or charge your payment method, at which point a sales contract is formed. Prior to that point, we may decline or cancel an order for any reason. If we cancel an order after you have been charged, we will refund the amount charged. 

Consumer Purchases vs. Business Purchases: 

Prairie Clean Enterprises sells primarily to consumers. If you are purchasing as a consumer, you benefit from mandatory protections under consumer protection laws. These Terms are intended to be interpreted in accordance with such laws. If you are purchasing on behalf of a business or for commercial use, then you agree that consumer protection legislation may not apply. Business purchasers also confirm that they have authority to bind the organization they represent. 

No Waiver of Statutory Rights (Severability of Prohibited Terms): 

No provision of these Terms will be interpreted to deprive a consumer of rights available under applicable law. If any provision is found void or unenforceable, that provision shall be deemed severed or modified, and the remainder shall remain in effect. 

Disclaimer of Warranties: 

THE SITE AND ALL MATERIALS ON THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT. Some content available through the Site may represent the opinions or judgments of an information provider, site user, or other person or entity not connected with us. We do not endorse, nor are we responsible for the accuracy or reliability of any opinion, advice, or statement made by anyone other than an authorized PCE spokesperson speaking in his/her official capacity. You understand and agree that temporary interruptions of the services available through the Site may occur as normal events. You further understand and agree that we have no control over third-party networks you may access in the course of the use of the Site, and therefore, delays and disruption of other network transmissions are completely beyond our control. 

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 

Limited Warranties (Products): 

PCE guarantees that the products will be free from material defects at the time of delivery. Any manufacturer’s warranty applicable will be passed on. PCE provides products on an “as-is” basis and disclaims other warranties to the fullest extent permitted by law. Statutory consumer warranties still apply. 

Limitation of Liability: 

IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES OR LOSSES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITE OR ANY WEBSITES REFERENCED OR LINKED TO FROM THE SITE. 

SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 

IN THE EVENT THAT ANY CLAIM OR LIABILITY ARISES AGAINST US, OUR AGGREGATE LIABILITY IN CONNECTION WITH THIS AGREEMENT, YOUR USE OF THE SITE AND/OR RELATED WEBSITES SHALL BE LIMITED TO DIRECT DAMAGES ONLY, AND SUCH DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF (A) $100 CAD AND (B) THE TOTAL AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM. 

You acknowledge that PCE has no control over, and no duty to take any action regarding: which users gain access to the Site; what content you access via the Site; what effects the content may have on you; how you may interpret or use the content; or what actions you may take as a result of having been exposed to the content. You release PCE from all liability for you having acquired or not acquired content through the Site. 

For Consumers: PCE is not liable for indirect or consequential damages unless required by law. For Business Purchasers: PCE’s liability is limited to the amount paid for the product. This limitation is a fundamental part of the bargain. 

Indemnification: 

Upon a request by us, you agree to defend, indemnify and hold harmless PCE and affiliates from any and all claims, liabilities and expenses, arising from your breach of these Terms, your misuse of the Site, or your violation of any third-party right including, without limitation, any intellectual property or privacy right.  

This defense and indemnification obligation will survive these Terms and your use of the Site.  

Governing Law and Forum for Disputes: 

The laws of the Province of Saskatchewan shall apply to the interpretation of these Terms, notwithstanding any conflict of law provisions. If there is any dispute regarding this Site, you agree that the dispute will be governed by the laws of the Province of Saskatchewan (without regard to conflict of laws provisions) and all matters will be submitted to the exclusive jurisdiction of the courts of the Province of Saskatchewan or a federal Canadian court.  

Those who choose to access the Site from outside Canada do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.  

Language of Contract: 

These Terms are provided in English. In case of conflict between language versions, the English version prevails. For consumers in Québec, a French version of these Terms will be made available upon request.

Entire Agreement: 

These Terms, along with our other policies, represent the complete agreement between you and PCE and supersede any prior agreements. 

Severability: 

If any part of these Terms is found to be invalid or unenforceable, the remaining portions will still apply. Severed clauses may be replaced by valid ones that match original intent where permitted. 

Termination: 

These Terms remain effective until terminated by either party. PCE may terminate access without notice for violations. 

Product Use Disclaimer 

Our products must be used in accordance with provided instructions. We are not responsible for misuse, improper storage, allergic reactions, or failure to follow usage guidelines. Customers are responsible for ensuring suitability for their household and pets. Customers are responsible for monitoring their pet’s reaction to the product. If any adverse reaction occurs, discontinue use immediately and consult a veterinarian. To the extent permitted by law, PCE is not responsible for adverse reactions resulting from individual sensitivities or improper use. 

Force Majeure: 

PCE is not liable for delays caused by events beyond its control, including natural disasters, war, pandemics, or infrastructure failures.

Introduction and Scope 

Prairie Clean Enterprises (referred to below as “PCE”, “us” or “we”) is committed to protecting the privacy of our customers and website users. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information on our Shopify-powered website and related services. It applies to all personal information collected from individuals in Canada and internationally. PCE maintains the privacy of your personal information in accordance with applicable privacy laws and this policy.

In order to comply with the requirements of the European General Data Protection Regulation (“GDPR”) for European users, this Privacy Policy outlines the legal basis on which we process your personal data (also referred to as personal information herein) and provides other information required by the GDPR. Generally, this means that we process personal data only where we have consent, where necessary to provide you with information, products, or services, or where necessary to comply with our legal obligations. We may also process personal data where otherwise allowed by the GDPR for the purposes outlined in this Privacy Policy (for example, to communicate with you and to respond to your requests). If you submit a request, please be specific as to what right you are asserting (e.g., access, correction, etc.) and which specific pieces of personal information are in the scope of your request. In some cases, in order to comply with applicable law or a legal obligation, PCE may deny your request or may seek more information from you in order to respond to your request. 

Accountability 

PCE has appointed a Privacy Officer responsible for compliance. Questions about your personal information may be directed to  meow@prairiecleanlitter.ca . We maintain internal policies and procedures to ensure personal information is handled according to this Policy and applicable laws. 

What Personal Information We Collect 

We only collect information as necessary to provide you with our services or for compatible purposes which we identify to you before or at the time of collection. This may include your name, contact details, payment info (processed securely), order history, login credentials, and communication records. With your consent, we may collect your name and email for marketing purposes. Information is collected directly from you unless otherwise permitted by law or with your consent. 

Visitors to the Site should be aware that anonymous technical information may be collected by PCE or its authorized third-party providers as a result of a visit to the Site. For example, this information may include the visitor’s IP address, browser type, operating system, domain name, access times and referring website addresses. PCE and its authorized third-party providers use this anonymous technical information for purposes such as diagnosing problems with the Site’s servers, improving the operation and content of the Site and compiling aggregate and statistical information. We will not attempt to link or match such anonymous technical information with any personally-identifiable information unless we have an individual’s consent, we (or our service providers) have detected or reasonably suspect any unlawful use of our services or a security breach, or we have a legal duty or right to do so. 

Purposes of Collection, Use, and Disclosure 

  • PCE’s Relationship with Individuals: To administer, plan, and manage PCE’s relationship with individuals. 

  • Communications: To communicate with individuals and provide requested information.

  • Order Fulfillment and Customer Service: To process and deliver orders, notify you of status, and handle returns.

  • Payment Processing: To securely process transactions via PCI-compliant gateways. We do not store full credit card data. 

  • Account Management: To manage login, order history, and preferences. Account data is stored securely on Shopify’s servers. 

  • Marketing and Newsletters: To send promotions and updates, only if you opt in. Such communications will be made in accordance with applicable laws. You may unsubscribe at any time. 

  • Personalization and Analytics: To improve user experience and website performance using tools like Google Analytics. Consent 

By using our site or submitting your information, you consent to our privacy practices. Consent is collected at the time of data entry. You may withdraw consent at any time, subject to legal limits. Withdrawal may affect our ability to fulfill services like processing orders or sending updates. 

Limiting Collection and Data Minimization 

We collect personal information fairly and only for necessary purposes. We do not request unnecessary identifiers (e.g., SIN or license number) and encourage you to share only the minimum required information. 

Limiting Use, Disclosure, and Retention 

We do not sell or rent personal data. We may share information with our third-party service providers for the purposes listed above, including:

We contractually require these providers to protect your data. Personal information is kept only as long as needed for its purpose or as required by law. For example: 

  • Tax records are retained for 7 years. 

  • Account data is retained while your account is active. Deleted accounts are anonymized where possible, except for legally required data. 

  • Opt-out requests are stored on suppression lists to ensure compliance with your preferences. 

We do not otherwise use or disclose personal information unless we have your consent, we have a good faith belief that disclosure of the information is necessary to protect the rights or property of PCE, or we have a legal duty or right to do so. 

Accuracy 

We make every reasonable effort to ensure that personal information is accurate and current. We rely on you to notify us if there is a change to your personal information, especially for service delivery. We will correct or amend personal information where it can be shown that the personal information is incorrect or incomplete. 

Safeguards 

We use physical, organizational, and technological measures to protect your data: 

  • Technological: SSL/TLS encryption, secure servers, firewalls, authentication controls, regular updates, and audits. 

  • Physical: Secure premises, restricted access, and shredding/disposal of sensitive documents. 

  • Organizational: Staff training, role-based access, and breach response protocols. 

No system is completely secure. In the event of a breach, we will notify affected individuals and authorities as required by law. We currently comply with PIPEDA and Quebec's Law 25 breach reporting obligations. 

Individual Access and Choices 

You may access or request correction of your personal information. Upon verifying your identity, we will disclose how we use and share your data. Some exceptions apply (e.g., legal privilege or another person’s data). Quebec residents may request data deletion under the "right to be forgotten." All requests will be handled in accordance with applicable law. 

Children’s Privacy 

Our site is not intended for users under 13. We do not knowingly collect data from minors without parental consent. If we discover such data, it will be deleted. For minors aged 13–18, we expect parental consent if personal data is provided. 

Cookies  

The Site uses standard technology known as “cookies”, including session cookies and persistent cookies. Session cookies temporarily keep your settings. This information is stored until your browser is closed. Persistent cookies are created for specific functions you may choose to use on the Site, including, but not limited to: accepting terms of use; saving searches; and saving favourites. Persistent cookies are used to improve your experience of the Site and are retained from session to session. These cookies remain after the browser is closed and are stored locally on your system. PCE does not track such cookies on PCE servers, nor does PCE use such cookies to store personal information. You may choose to delete persistent cookies after visiting the Site. If you do not wish to accept cookies, you have the option of blocking or disabling cookies. However, please be aware that you may be unable to access certain parts of the Site if you do block or disable cookies.

Our website may contain links to other sites. We are not responsible for their privacy practices and recommend reviewing those third-party privacy policies separately.

This Privacy Policy may be updated from time to time. Changes will be posted with an updated effective date. Significant changes may also be communicated via email or site notice. Continued use of our services implies acceptance of the updated Policy unless additional consent is required by law. 
Scope 

This Shipping Policy outlines how Prairie Clean Enterprises, operating as “Prairie Clean Litter” (referred to below as “PCE”, “us” or “we”) handles order shipment, delivery, taxes, and logistics for online purchases (“Products”). It applies to Canadian shipments. 

Order Acceptance and Cancellation 

You agree that your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered. 

Order Processing Time 

Orders are processed Monday to Friday (excluding holidays), typically within 1–5 business days of confirmation. Orders after 2:00 PM local time may process the next business day. Peak periods may cause slight delays. Customers will be notified of backorders or delays by email. We are not liable for any delays in shipments. 

Shipping Methods and Carriers 

We offer standard shipping. Standard shipping within Canada usually takes 3–7 business days and may take 7–14 business days for remote locations. Carriers may include Canada Post, UPS, FedEx, or DHL. Shipping charges and estimated delivery dates are shown at checkout. All delivery estimates are approximate, not guaranteed. Orders may be fulfilled and shipped by authorized third-party logistics providers acting on our behalf.

Shipping Regions 

We ship to all Canadian provinces and territories. If your region is not available at checkout, we currently cannot ship there.

Sales Taxes (Canadian Orders) 

Orders shipped within Canada are subject to federal and provincial taxes, calculated at checkout. PCE is registered to collect GST/HST, PST (including SK PST No. 7598337), and other applicable taxes.

Shipping Fees and Adjustments 

PCE charges shipping fees based on the number of products purchased per order. These shipping rates are clearly disclosed at checkout prior to purchase. 

PCE reserves the right to modify its shipping fees at any time to reflect changes in carrier rates, fuel surcharges, operational costs, or other factors. Any such changes will apply only to future orders and will always be displayed prior to checkout. 

For one-time purchases, the shipping fee shown at checkout is final for that transaction and will not be changed after the order is placed. 

For subscription orders, PCE may adjust applicable shipping fees from time to time. Where required by applicable law, PCE will provide advance notice of any change in shipping fees before it takes effect. Updated shipping fees will apply at the start of the next billing or shipment cycle following such notice. If you do not agree to the updated shipping fee, you may cancel your subscription prior to the next billing date without penalty, subject to applicable laws. 

PCE will not apply shipping fee increases retroactively to orders already placed or billed. 

In all cases, PCE will comply with applicable Canadian consumer protection laws, including requirements related to disclosure, consent, and cancellation rights. 

For consumers residing in Québec, any change to applicable shipping fees for subscription orders will be communicated in a clear and comprehensible manner before the change takes effect. Such notice will include the updated shipping fee and the date on which it will apply. 

Where a change to shipping fees constitutes a material modification, you will have the right to refuse the change and cancel your subscription without cost, penalty, or cancellation fee, effective before the change comes into force. 

No shipping fee will be charged unless it has been expressly disclosed prior to the completion of the transaction. By completing your order, you expressly agree to the applicable shipping fee presented at checkout. 

PCE will not impose or collect any shipping fee that is not clearly indicated at or before the time of purchase, in accordance with Québec’s Consumer Protection Act. 

Force Majeure and Delivery Delays 

PCE is not liable for delays caused by events beyond our reasonable control (e.g., without limitation, weather, natural disasters, strikes, customs delays, defaults of common carriers, or any other commercial impracticability or cause beyond our reasonable control). We will notify customers of delays where reasonably possible and issue refunds if necessary. If delays prevent fulfillment, the order may be cancelled with a full refund. 

Loss or Damage in Transit 

Risk of loss transfers to the customer once the carrier receives the order. If your package is lost or damaged, contact us immediately. We will work with the carrier to resolve the issue and may request documentation (e.g., photos or declarations). Replacements or refunds will be issued for confirmed cases. 

Delivery and Acceptance 

Delivery of the Products will take place when we deliver the Products to the address that you have provided to us. You will be responsible for the Products when delivery has taken place (including ensuring that you follow any instructions or manuals provided with the Products) and you will own the Products when we receive payment in full for them and any respective delivery charges. You will be deemed to have accepted the Products if you have received and taken possession of them and have not notified PCE of any damage or non-conformity within the applicable notice period. 

Delivery Policy and Failed Deliveries 

Customers are responsible for providing accurate shipping information. If an order is returned due to incorrect address or non-collection, reshipment fees may apply. If tracking shows delivery but you didn’t receive it, check with household members or neighbours, then contact us. We may require a declaration before issuing a refund or replacement. 

Pre-Orders and Backorders 

For pre-orders or backorders, the estimated shipping date is shown on the Product page. Orders may be cancelled for a full refund anytime before shipment. If shipping is delayed more than 30 days past the original estimate, you may cancel for a full refund under applicable laws. 

Fraud, abuse, or repeated claims 

We reserve the right to investigate and deny claims for refunds or replacements in cases of suspected fraud, abuse, or repeated claims of non-delivery. We may require supporting documentation, including declarations or identification, before issuing a refund or replacement. 

Customer Pickup Option 

Local pick up is not available at this time. If local pickup becomes available (e.g., Regina, SK), customers must collect orders within the stated window (usually 7 days). Unclaimed orders may be cancelled and refunded (less restocking fees, if any). Please bring ID and your order confirmation to collect your item. 

We shall not be liable for any loss, damage, defect or non-conformity of Products if: (i) you make any further use of such Products after you give such notice; (ii) the defect arises because you failed to follow the applicable instructions as to the storage, installation, commissioning, use or maintenance of the Products; or (iii) you alter or repair such Products without our prior written consent. 

THE REMEDIES SET FORTH IN THIS POLICY SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THE LIMITED WARRANTIES SET FORTH IN THIS POLICY. 

Limitation of Liability 

IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSS OF USE, REVENUE OR PROFIT, OR FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR AGGRAVATED DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE. 

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS POLICY, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED THE AMOUNTS PAID BY YOU FOR THE PRODUCTS AND SERVICES SOLD THROUGH THE SITE.

Statutory Warranties and Consumer Rights 

All products sold by Prairie Clean Enterprises, operating as “Prairie Clean Litter” (referred to below as “PCE”, “us” or “we”) include the statutory warranties mandated by law. We honour all legal implied warranties of fitness, quality, and durability under applicable provincial sale-of-goods and consumer protection laws. Nothing in this policy limits your rights. If a product is defective or not as described, you may be entitled to repairs, replacements, or refunds. We do not exclude liability for breach of statutory warranties where prohibited by law. 

Except for the warranties set forth above, PCE makes no condition or warranty whatsoever with respect to any products sold by PCE, whether express or implied by law, course of dealing, course of performance, usage of trade or otherwise. 

Returns Eligibility and Process 

You may return most new, unopened items within 30 days of delivery for a full refund. To start a return, contact our Customer Care team with your order details. Items must be returned in original condition and packaging unless they arrived damaged or defective. PCE may refuse returns or charge a restocking fee for non-compliant or late returns unless a longer period is required by law. Refunds are issued within 15 business days of receiving the returned items and credited to your original payment method.  

Provincial Consumer Protections 

This policy is designed to comply with the strongest consumer protection standards across Canada. Where provincial laws provide additional cancellation or return rights, they will apply. For example, delays in delivery or missing required disclosures may allow contract cancellation under Ontario or BC laws. In such cases, we will issue full refunds within the timeframe required by law (e.g., within 15 days of notice). 

Refunds and Treble Damages 

When a return is accepted, we refund the purchase price and applicable taxes. Shipping costs are non-refundable unless the return is due to our error or a product defect. Refunds are issued to your original payment method. If PCE fails to issue a required refund, consumers may be entitled to further remedies. For example, Ontario’s upcoming Consumer Protection Act, 2023 may allow triple damages for refund enforcement. PCE aims to fully comply with all refund obligations. 

No Mandatory Arbitration or Class Action Waiver 

We do not require consumers to submit to arbitration or waive class action rights for return-related disputes where prohibited by law. Provinces like BC and Ontario bar such clauses in consumer contracts. You may seek resolution in court or through provincial dispute resolution services (e.g., BC’s Civil Resolution Tribunal). 

Final Sale Items and Exceptions 

Some items are final sale, such as perishable goods, hygiene items, and custom-made products. These will be clearly labeled at checkout. This does not affect your right to a remedy if the item is defective. Gift cards and downloadable products are non-refundable unless required by law. Refunds for gifts go to the original purchaser unless otherwise arranged. 

Process for Refunds 

Once your return is received and inspected, you’ll receive an email confirmation. Approved refunds are issued within 15 business days of return receipt or valid cancellation notice. If you have not received your refund after 15 days, please contact us to investigate.

Overview: 

This Order Cancellation Policy outlines the conditions and procedures under which you may cancel an order (either before or after it has been shipped) and the rights and remedies available to you under the policies of Prairie Clean Enterprises, operating as “Prairie Clean Litter” (referred to below as “PCE”, “us” or “we”) policies and applicable laws. Our goal is to offer flexibility and transparency, while also incorporating the latest provincial consumer protection updates regarding cancellation rights. 

Cancellation Before Shipment (Change of Mind): 

If you wish to cancel your order before it has been shipped, please contact us immediately at  meow@prairiecleanlitter.ca  with your order number. We will make every reasonable effort to accommodate your request. If the order is still in our processing queue and has not yet been dispatched, we will cancel the order and issue you a full refund to your original payment method. No fees will apply for early cancellations of unshipped orders. However, if the order has already been handed over to the carrier or has been marked as shipped in our system, you will not be able to cancel it through this pre-shipment process – in that case, please refer to the “After Shipment” section below. Note: Custom-made or personalized items may be non-cancellable once production has begun, which will be indicated on the product page. 

Statutory Cancellation Rights (Distance Sales Contracts): 

In addition to our voluntary policies, you may have legal rights to cancel certain orders under provincial consumer protection laws. For example: 

  • Under many provincial regulations governing internet sales or distance contracts, if we fail to provide you with required pre-contract information or a copy of the contract within the prescribed time, you have the right to cancel the contract within a specified period (often 7 days from when the contract was to be delivered or 30 days if no delivery date was provided, depending on the province). 

  • If we fail to deliver the goods within 30 days of the promised delivery date (or if no delivery date was stated, within 30 days of the order date), and this failure is not due to you or an unforeseen event out of our control, many provinces allow you to cancel the contract by providing notice to us. 

  • PCE has structured its Terms and practices to comply with applicable consumer protection laws.  

To exercise a statutory cancellation right, you should send us a clear notice of cancellation referencing your order number and the law or reason (though you are not always required to cite the law, doing so can help us process it correctly). The notice can be sent via email or any other method allowed. We will promptly acknowledge your cancellation request and, if the cancellation is valid under applicable law, we aim to provide a full refund within 15 days of receiving your cancellation notice or of the effective date of cancellation. Refunds will include all amounts you paid, including standard outbound shipping charges (if any were charged on the order), as mandated. 

Cancellation After Shipment / Refusal of Delivery: 

If your order has already been shipped and you wish to cancel, you may opt to refuse delivery when the carrier attempts delivery (if feasible). Alternatively, once the package is delivered, you may still be eligible to return it under our Return and Refund Policy. Please note that simply refusing or returning a package without notifying us might delay the refund process. If you cancel after shipment for convenience, we may deduct the return shipping cost from your refund, unless prohibited by law. No restocking fee will be charged for cancellation of delivered orders if they are unopened and returned promptly. 

Non-Delivery or Lost Orders: 

If your order is confirmed as lost in transit, you have the right to cancel the order and receive a full refund. We will typically offer to send a replacement at no extra cost, but the choice will be yours. If an item is back-ordered or unavailable to ship after you’ve ordered, we will inform you and you can opt to cancel for a full refund if you prefer not to wait. 

Exchanges in Lieu of Cancellation: 

In some cases, you may prefer to exchange an item rather than cancel the order outright. An exchange is treated as a cancellation and new purchase. If the exchange is due to an error on our part or a product issue, we will cover all costs. If it’s for personal preference, price differences and new shipping charges may apply. 

Procedure to Cancel or Return: 

To cancel an order under this Policy, please follow these steps: 

  1. Contact Us: Email meow@prairiecleanlitter.ca   or call (306) 910-3529. Provide your order number and reason. 

  2. Receive Confirmation: We will confirm if cancellation is possible or advise next steps for shipped orders. 

  3. Return Merchandise (if applicable): We’ll provide an RMA number and return instructions. Return items within 15 days of cancellation notice. 

  4. Packaging: Use secure packaging and include all original materials. 

  5. Proof of Shipment: If shipping the return yourself, keep a tracking number as proof. 

  6. Refund: Once we receive the item (or proof of shipment), we’ll issue a refund—usually within 15 days. 

Subscriptions and Ongoing Services: 

If your order involves a subscription, see our Subscription Policy. In general, subscriptions can be cancelled any time without penalty, though timing may affect refunds. 

Effects of Cancellation: 

When you cancel, any ancillary contracts (e.g., financing) are also cancelled. We’ll help notify third-party lenders. Loyalty points, if applicable, will be removed, and gift card purchases refunded as gift card credit.

We reserve the right to investigate misuse of cancellation rights. Repeated abuse may result in declined future orders. Genuine customer protections will always be honoured.

By placing an order with PCE, you acknowledge that you have read and understood this Order Cancellation Policy. We are committed to fair dealing and to upholding your legitimate cancellation rights. 
Scope: 

This Subscription Policy applies to any products or services offered by Prairie Clean Enterprises, operating as “Prairie Clean Litter” (referred to below as “PCE”, “us” or “we”) on a subscription, recurring delivery, or auto-renewal basis (“Subscription”). Examples may include a monthly delivery of product or products, an auto-renewing product delivery plan, or any other arrangement where you are billed periodically and products are delivered or services provided on a schedule. By enrolling in a Subscription, you agree to the terms of this policy, which supplement our general Terms of Service and do not override any consumer rights you have by law. 

Subscription Enrollment and Consent: 

When you sign up for a Subscription, we will clearly present the terms of the automatic renewal before you complete your purchase, in accordance with applicable “continuous disclosure” laws. This includes details such as the billing period, the amount that will be charged, any minimum commitment or introductory pricing, and how to cancel. You will be required to provide express consent to the Subscription terms. After enrollment, we will send you a confirmation (in a durable medium such as email) outlining the Subscription terms and how to cancel. 

Free Trials and Promotions: 

If your Subscription begins with a free trial or discounted introductory period, the duration and terms will be clearly indicated at sign-up. You will not be charged during the free trial period. After the trial ends, you will automatically be charged unless you cancel before it expires. Only one trial per household or user is allowed unless otherwise stated. 

We reserve the right to deny promotional pricing, free trials, or introductory discounts to accounts, households, payment methods, IP addresses, or shipping addresses that have previously participated in such promotions. 

Automatic Renewal: 

Subscriptions automatically renew at the end of each term unless cancelled. Your payment method will be charged at each renewal. For short-term subscriptions (less than 60 days), you may cancel anytime without penalty. For longer-term subscriptions, we will provide a renewal reminder between 30–60 days before the end of the term. It is your responsibility to cancel before renewal, but we aim to send reminders where required. 

Cancellation of Subscription: 

You may cancel your Subscription at any time. You can cancel via your account settings or by contacting support. We will not require unreasonable steps to cancel. Cancellations should be made at least 30 days prior to the next billing date. No cancellation fees apply. You will retain access for the remainder of the paid period. For prepaid Subscriptions, contact us to request a prorated refund (granted at our discretion or where required by law). 

Confirmation and Record of Consent: 

We maintain records of subscriber consent in compliance with federal and provincial rules. You may request a record of your agreement at any time. 

Subscription Price Changes: 

PCE may change prices, but only at the start of a new billing period and with advance notice. If you don’t agree to the new price, you may cancel. We will not retroactively increase prices. Under applicable laws for your province or territory, you may cancel without penalty upon receiving price change notice if required by law. 

Failed Payments: 

If a payment fails, we’ll notify you and try again. Continued failure may result in suspension or cancellation. We don’t charge late fees, but you remain responsible for unpaid charges. You must keep your payment information current. 

PCE reserves the right to pursue all available legal remedies to recover unpaid amounts. You agree that you will be responsible for any costs incurred by PCE in connection with the collection of unpaid charges, including reasonable legal fees and collection agency fees.  

Subscription Notifications and Communication: 

You consent to receive Subscription-related notifications. These include order confirmations, shipment notices, renewal alerts, and updates on substitutions. Such notifications will be made in accordance with applicable laws.

Customer Rewards or Discounts on Subscriptions: 

Promotional offers like discounts or loyalty rates will be clearly disclosed. If you cancel and re-subscribe, the same discount may not apply. We will honour the lowest advertised rate or allow cancellation in cases of discrepancy. 

Compliance with Automatic Renewal Laws: 

This policy is designed to comply with applicable automatic renewal laws in Canada and beyond. If you ever feel misinformed or unable to cancel, please contact us. 

Refunds for Prepaid Subscriptions: 

If you cancel a prepaid Subscription, we may calculate refunds based on non-discounted usage. We will explain the calculation. No penalties will apply. Where laws mandate specific refund formulas (e.g., Manitoba), we will follow them. Our goal is fairness. 

Modifications to Subscription Service: 

We reserve the right to modify or discontinue the Subscription service. If your Subscription is discontinued, we will stop billing and notify you. If any material changes are made, we will notify you and allow you to cancel before changes take effect. 

By purchasing a Subscription from PCE, you confirm that you understand and agree to this Subscription Policy. We are committed to providing a transparent and reliable subscription experience in compliance with B.C.’s Bill 4, anticipated federal changes, and other applicable consumer terms and policies effective date: March 25, 2026 unless otherwise noted.
